We reached our current strength because our employees, customers, and shareholders believe in the same fundamental goals: Delivering a wide variety of financial services with a superior customer service guarantee.Analyzes and processes bankruptcy filings, delinquent legal accounts and probate claims on all assigned consumer and commercial loans. - Coordinates with consumer and commercial loan adjustment officers, branches and branch support in arranging work outs, liquidation or legal courses of action to follow in minimizing financial loss. - Works with legal counsel in preparing cases of court and follow up after relief or judgment received.Bankruptcies - - - - - - - - - - - - - Manages all assigned bankrupt consumer and commercial loans. - - - - - - - - - - - - Prepares and files court documents including Proofs of Claims, Reaffirmation Agreements, Stipulations, and Orders - - - - - - - - - - - - Analyzes and implements bankruptcy workout plans to maximize loan recoveries and minimize losses. - - - - - - - - - - - - Coordinates bankruptcy legal action with Bank legal counsel for relief of stay and plan objection motions.Litigation - - - - - - - - - - - - Manages the litigation of assigned defaulted consumer loans. - - - - - - - - - - - - Prepares and files Small Claims Court documents and represents Bank at hearings. - - - - - - - - - - - - Coordinates litigation with Bank legal counsel on large or complex loans, including Breach of Contract and Writ of Possession legal action. - - - - - - - - - - - - Represents Bank as witness at hearings. - - - - - - - - - - - - Pursuant judgments by obtaining Writs of Execution and coordinating with authorities for levies against wages, deposit accounts, and other assets. - - - - - - - - - - - - Prepares and records Abstracts of Judgment and Satisfaction of Judgment documents.Probate - - - - - - - - - - - - Manages all assigned probate consumer and commercial loans. - - - - - - - - - - - - Prepares and files probate claims. - - - - - - - - - - - - - - - - - - - - - Coordinates claims with Bank legal counsel as necessary.Performs additional job-related duties as required.MINIMUM KNOWLEDGE, PRIOR WORK EXPERIENCE, AND SKILLS NEEDED TO PERFORM JOB FUNCTIONS:Previous work experience in a consumer lending and/or collections position where incumbent has gained a working knowledge of the legal activities, terminology and laws associated with lending, collections and bankruptcies. - Paralegal certificate a plus. - Familiarity with banking terminology and lending products desirable. - Incumbent must possess excellent communication, organizational, interpersonal and analytical skills. - Must be PC literate in MS Word and Excel.COMPLEXITY OF ANALYSIS:Requires innovation and analysis to solve moderately complex problems. - Erroneous decisions may result in further litigation with debtors, and adversely impact the recovery of lost loan revenue.EOEWestamerica Bank's Privacy Policy may be found at: - - www.westamerica.com/about/privacy
